Block Day 1
Receive trial information. Break up into Prosecution/Defense Teams. Begin Reviewing
the case. Complete all the duties listed under As a Team. Begin work on your
strengths/weaknesses chart and time line of events. -Judge & Bailiff- Review
case and work on strengths/weaknesses chart and time-line of events.
Block Day 2
Finish anything left from day one. Discuss strengths/weaknesses chart and time
line with your team.
Decide what approach your side should take. Which witness will help you the
most? How can you minimize or rationalize the holes in your case? Will you set
up any demonstrations for the jury? Will you need the overhead projector or
charts? What alternative explanation can you suggest for actions, behaviors,
statements by witnesses? Plan your strategy.
-Judge & Bailiff- work on completion of your listed work on the duties page.
Block Day 3
Work day for attorneys and witnesses. Be writing questions and statements.
Judge & Bailiff- study your duties for the trial
Block Day 4
Rehearse!!!!! Run through trial in your groups. Work on any weak areas.
Day 5 Trial begins

------DUTIES
Judge and Bailiff:
Both Must: (you may work on these together but you each must hand in your own copy)
1. Read through the whole case. Write out what you see as the strengths and weaknesses of each side.
2. Make a timeline of important events in the case
3. Write out a very complete Steps in a Trial sheet, which you will use for reference during the trial. This should include every possible step (even optional steps) and what you might say during the trial.
Judge:
4. You must carefully study the Simplified Rules of Evidence so you will know when to overrule or sustain an objection. (Practice situations with the bailiff.)
5. The behavior of people in the courtroom is largely under your authority. Be thinking of what you will say if participants are not attentive, or disruptive, or if attorneys are combative with each other.
Bailiff:
4. Get any props together you will need. When the day of trial comes help set up the courtroom.
5. Get a list of who is playing the role of each witness and make a copy for each team, the judge, me, and yourself. Distribute the copies.
Prosecution/Defense Teams: (This includes all attorneys and witnesses for your side)
As a Team you are to:
Pick a lead attorney. This person will direct your team's activities and fill
out a Role Assignment sheet for your team. (Teammates assist in this process
as needed).
Make the following decisions-
Decide who will play the role of each of your witnesses.
Decide which attorney's will work with which of your witnesses to prepare and practice Direct Examination questions.
Decide which attorney's will prepare Cross Examination questions for which opposing side witnesses.
Decide which attorney's will prepare and practice Anticipated Cross Examination questions for your side's witnesses
Decide which attorney's will prepare and deliver the Opening Statement.
Decide which attorney's will prepare and deliver the Closing Statement
